Welcome to TheMarket Robo, operated by TMKR Global, LLC ("we," "us," "our," or "Company"), a platform providing digital trading tools, algorithmic trading robots, and related services. These Terms of Service ("Terms," "Agreement") govern your access to and use of our website, services, and digital products.
Please note the following:
TheMarket Robo is a marketplace platform for digital trading tools.
We do not provide financial, investment, or trading advice.
We are not a broker, dealer, or financial institution.
All trading decisions and outcomes are your sole responsibility.
Payments are processed through our chosen payment provider. Payment methods and processor details will be disclosed at checkout. By making a purchase, you agree to the payment terms presented at the time of purchase.
By accessing our website, creating an account, purchasing our products, or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services or purchase our products.
**These Terms constitute a legally binding agreement between you and TMKR Global, LLC, operating as TheMarket Robo.** Please read them carefully before making any purchase or using our services.

By accessing, browsing, or using our website, services, or purchasing our digital products, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations.
You represent and warrant that:
You are at least 18 years of age
You have the legal capacity to enter into binding agreements
You are not prohibited from using our services under applicable laws
All information you provide is accurate and truthful
We reserve the right to modify these Terms at any time. Material changes will be notified through our website or via email. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.
For the purposes of these Terms:
**"Digital Trading Tools"** or **"Products"** refers to algorithmic trading robots, trading software, indicators, expert advisors, and related digital products sold through our platform.
**"License"** refers to the limited, non-exclusive, non-transferable right to use a purchased Product for the duration specified in the purchase agreement.
**"User," "You," "Your"** refers to any individual or entity accessing or using our services.
**"Account"** refers to your registered user account on our platform.
**"Order"** refers to a completed purchase transaction for a Product.
**"Platform"** refers to TheMarket Robo website, services, and infrastructure.
We provide digital trading tools including but not limited to algorithmic trading robots, expert advisors, trading indicators, and related software products. Product descriptions, features, and specifications are provided for informational purposes only.
Products are subject to availability. We reserve the right to discontinue, modify, or limit the availability of any Product at any time without prior notice. We are not obligated to provide any specific Product or maintain its availability.
Products may be updated, modified, or replaced with new versions. We do not guarantee that updates will be provided or that your purchased version will remain compatible with trading platforms or systems.
Some Products may be created by third-party vendors. We act as a marketplace and are not responsible for the functionality, performance, or outcomes of third-party Products beyond facilitating the transaction.
When you place an order:
You make an offer to purchase a Product at the listed price
We reserve the right to accept or reject any order
An order is considered accepted when payment is successfully processed
Upon payment completion, a License is automatically created and activated
All prices are displayed in the currency specified on our website. Prices are subject to change without notice. The price charged is the price displayed at the time of purchase completion.
**Tax Handling:** Where applicable, sales tax, VAT, or other taxes may be calculated and collected at checkout based on your location and applicable tax laws. The final price you pay will include any applicable taxes. Tax compliance is handled in accordance with the payment terms presented at checkout.
Payment must be made in full at the time of purchase using the payment methods offered at checkout. Payment methods and processor are not currently assigned; details will be disclosed when you complete a purchase. We are not liable for payment processing errors, failures, or issues arising from the payment provider's services.
Once payment is successfully processed and the order status changes to "completed," the License is immediately activated and the transaction is final. **No cancellations or refunds are permitted after order completion.**
If payment fails, your order will not be completed and no License will be created. You may retry payment up to 3 times. After the retry limit, you must create a new order.
In accordance with international consumer protection laws regarding digital content, by accessing, downloading, or activating a License for our digital software, you explicitly acknowledge and agree that you waive your standard right of withdrawal or "change of mind" refund.
We strictly do not offer refunds for dissatisfaction with trading performance, market conditions, or financial losses incurred while using our software.
Refunds or subscription credits are only issued in the strict event of (a) **non-delivery** of the digital product or license access you paid for, or (b) a **material** technical failure of the software or our delivery mechanism during your active subscription or license period that prevents materially conforming use as described in the applicable listing and terms, and that our technical support team is unable to resolve within a reasonable timeframe after you reasonably cooperate with troubleshooting. We do not refund for change of mind, trading losses, or general dissatisfaction unrelated to (a) or (b).
You may cancel your recurring subscription at any time through your user dashboard. Cancellation will prevent future billing, and your software access will remain active until the end of your current paid billing cycle.
Chargebacks and payment disputes are handled by the payment provider used at checkout. If you have a legitimate concern, please contact our support team first. We will work with you to resolve any issues. Initiating a chargeback or payment dispute with your payment provider after purchasing our Products without first contacting our support team constitutes a violation of these Terms and may result in your account being suspended or terminated, Licenses being revoked, and you being permanently banned from our platform.
Upon successful purchase, we grant you a limited, non-exclusive, non-transferable, revocable License to use the purchased Product for the duration specified in your purchase agreement (e.g., monthly, yearly).
Your License is subject to the following restrictions:
**Non-Transferable:** Licenses cannot be transferred, sold, or assigned to another person or entity
**Non-Exclusive:** We may grant Licenses to other users
**Single User:** Each License is for use by a single user account only
**Session Limits:** License usage is subject to concurrent session limits based on your plan type
**Validity Period:** Licenses are valid only for the purchased duration period
You may NOT:
Copy, reproduce, or duplicate the Product
Reverse engineer, decompile, or disassemble the Product
Modify, adapt, or create derivative works from the Product
Share, distribute, or resell the Product or License
Use the Product for any illegal or unauthorized purpose
Remove or alter any copyright, trademark, or proprietary notices
We reserve the right to revoke your License immediately, without refund, if you violate these Terms, engage in fraudulent activity, or breach any applicable laws or regulations.
You are responsible for:
Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access
Using strong, unique passwords
**IMPORTANT: TRADING RISKS AND USER RESPONSIBILITY**
**Trading in financial markets involves substantial risk of loss and is not suitable for all investors.** By purchasing and using our trading robots and indicators, you acknowledge and accept full responsibility for all trading activities and outcomes.
**You acknowledge and agree that:**
**Full Responsibility:** You are fully and solely responsible for running our trading robots and indicators on your real trading accounts. You understand that trading always involves risks, including the risk of losing your entire investment.
**No Guarantees:** Past performance does not guarantee future results. Historical results displayed for any robot or indicator are not indicative of future performance.
**Independent Evaluation:** You must conduct your own thorough investigation, research, and evaluation before selecting and deploying any robot or indicator on your real trading account.
**No Responsibility for Real Account Trading:** We have no responsibility or liability of any kind for trades executed on real or live trading accounts. All trading on real or live accounts is at your sole risk. We are not responsible for, and do not accept any liability for, any financial losses, trading losses, or damages incurred while using our Products on real or live trading accounts, regardless of the cause.
**No Liability:** TMKR Global, LLC, operating as TheMarket Robo, its officers, directors, employees, agents, and affiliates shall not be liable for any losses, damages, or negative outcomes resulting from your use of our Products on real or live trading accounts, or from any trading activity whatsoever.
**Risk Management:** You should only trade with funds you can afford to lose. You are responsible for implementing appropriate risk management strategies and monitoring your trading activities.
**No Investment Advice:** Our Products are tools designed to assist in trading activities. We do not provide investment advice, and our Products should not be considered as such.
**Market Conditions:** Trading results depend on various factors including market conditions, economic events, and other factors beyond our control.
By purchasing and using our trading robots and indicators, you confirm that you have read, understood, and agree to assume full responsibility for all trading activities and outcomes. You acknowledge that you are using our Products with open eyes, having conducted your own investigation and evaluation, and you accept all risks associated with trading in financial markets.
You are responsible for ensuring that your use of our Products complies with all applicable laws, regulations, and trading platform rules in your jurisdiction.
You are responsible for ensuring your systems meet the technical requirements for using our Products. We are not responsible for compatibility issues or system failures.
You agree NOT to:
Use our Products for any illegal purpose or in violation of any laws
Attempt to gain unauthorized access to our systems or other users' accounts
Interfere with or disrupt our services or infrastructure
Use automated systems to access our website or services without permission
Impersonate any person or entity or misrepresent your affiliation
Transmit viruses, malware, or any harmful code
Collect or harvest information about other users
Use our Products to engage in market manipulation or fraudulent trading
Violate any intellectual property rights
Initiate chargebacks or payment disputes without valid cause
Violate the acceptable use policy of the payment provider used at checkout
You must comply with the terms and acceptable use policy of the payment provider used at checkout. Violation may result in termination of your account and revocation of all licenses.
All content, Products, software, trademarks, logos, and materials on our platform are owned by TMKR Global LLC (operating as TheMarket Robo) or our licensors and are protected by copyright, trademark, and other intellectual property laws.
Unauthorized use of the mark TheMarket Robo (including in domain names, marketing, or products) is prohibited. TheMarket Robo is a registered trademark of TMKR Global LLC in Georgia. We may enforce our rights against unauthorized use.
Some Products may contain third-party intellectual property. Respect for third-party rights is required, and you may not violate any third-party intellectual property rights.
Your purchase grants you only the License rights specified in Section 7. You do not acquire any ownership rights in the Products or our intellectual property.
OUR PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We disclaim all warranties, including but not limited to:
Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or completeness of information
Uninterrupted or error-free operation
Results or performance guarantees
**We make no warranties or guarantees regarding trading results, profits, or performance.** Trading involves risk, and past performance does not guarantee future results. You may experience losses while using our Products.
While we strive to provide functional Products, we do not guarantee that Products will be error-free, compatible with all systems, or meet your specific requirements.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEMARKET ROBO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
**TMKR Global LLC (operating as TheMarket Robo) is not responsible for any financial losses, trading losses, or damages resulting from your use of our Products, including any trades on real or live trading accounts.** You acknowledge that trading involves risk and that you may lose money. We have no liability for any losses incurred.
To the extent permitted by law, our total liability for any claims arising from or related to these Terms or our Products shall not exceed the amount you paid for the specific Product giving rise to the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless TMKR Global LLC (operating as TheMarket Robo), its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:
Your use of our Products or services
Your violation of these Terms
Your violation of any law or regulation
Your infringement of any intellectual property or other rights
Any trading activities or decisions made using our Products
You may terminate your account at any time by giving us at least 30 days' prior notice in writing. Termination of your account does not entitle you to any refunds for purchased Products or unused License periods.
We reserve the right to suspend or terminate your account and revoke all Licenses immediately, without notice or refund, if you:
Violate these Terms
Engage in fraudulent activity
Initiate unauthorized chargebacks or payment disputes
Violate any applicable laws or regulations
Abuse our services or other users
Violate the payment provider's acceptable use policy
Fail to comply with the payment provider's requirements
We may also terminate this Agreement by giving you at least 30 days' prior notice in writing for any reason, or immediately if required by the payment provider or any payment method provider.
Upon termination, your access to our Products and services will be immediately revoked. All Licenses will be deactivated, and you will lose access to purchased Products. No refunds will be provided.
We reserve the right to modify these Terms at any time. Material changes will be posted on our website with an updated "Last Updated" date. Your continued use of our services after modifications constitutes acceptance of the updated Terms.
If you do not agree to modified Terms, you must stop using our services immediately. No refunds will be provided for Products purchased under previous versions of these Terms.
These Terms shall be governed by and construed in accordance with the laws of Georgia, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Georgia.
Any disputes arising from or related to these Terms or our Products shall be resolved through binding arbitration in accordance with the rules of [Arbitration Organization], except where prohibited by law.
You agree that any disputes will be resolved individually and that you will not participate in class action lawsuits or class-wide arbitration.

BY USING THEMARKET ROBO SERVICES OR PURCHASING OUR PRODUCTS, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE AND THAT WE HAVE NO RESPONSIBILITY FOR TRADES ON REAL OR LIVE ACCOUNTS.
These Terms of Service are effective as of the date listed above and apply to all users and purchases made through TheMarket Robo.
